New Days OFF according Reform to Decree # 42-2010
Eight years ago Guatemalan Congress passed a law to promote the national tourism using the holidays dates to generate extended week end so people can have a better use of their holidays.
So this new modification introduce the following changes
This law is only for the following days :
- 1st of may
- 30th of june
- 20th of october
- en futures days in futures laws
What happen then...?
Two situations:
- When the holiday coincides on Tuesday or Wednesday, Enjoy the day immediately preceding Monday
- if it occurs on Thursday, Friday, Saturday or Sunday, will enjoy the next Monday immediately.
But the following days are excluded which means they are taken the day they are following on , they don't move
- 1st of january
- hald wednesday, thursday and friday of Easter week
- 10th of may
- 15th of september
- 1st of november
- hald day of the 24th of december
- 25th of december
- half day of 31st of january
- and the day of the Saint Patron of the village, city..

REFORMA AL DECRETO NÚMERO 42-2010 DEL CONGRESO DE LA REPUBLICA, LEY QUE
PROMUEVE EL TURISMO INTERNO
Artículo 1.
Se reforma el artículo 2 del Decreto Número 42-2010 del Congreso de
la República, Ley que Promueve el Turismo Interno, el cual queda así:
“ Articulo 2. Día de Asueto. Con el
objeto de promover el turismo nacional, cuando el día de asueto coincida en día
martes o miércoles, se gozara el día lunes inmediato anterior, si ocurriere en día jueves, viernes , sábado o domingo, se gozará el día lunes
inmediato siguiente.
Como
consecuencia la presente Ley se aplicara para los siguientes asuetos: uno de
mayo, treinta de junio, veinte de octubre y en todo caso, los descansos
establecidos en otras leyes.
Se
exceptúan de la aplicación de la presente Ley, los días: uno de enero, medio
día del miércoles santo, jueves y viernes santo; diez de mayo, quince de
septiembre, uno de noviembre, medio día del veinticuatro de diciembre,
veinticinco de diciembre, medio día del treinta y uno de diciembre y el día de la
festividad de la localidad.”
Artículo 2. Se adiciona el articulo 2 bis al Decreto
Número 42-2010 del Congreso e la República, Ley que Promueve el Turismo
Interno, el cual queda as:
“Artículo 2 bis. Derogatorias. Se
derogan todas las disposiciones que contradigan el presente Decreto.”
Artículo 3. El presente Decreto entrará en vigencia ocho
días después de su publicación en el Diario Oficial.
ENGLISH TRANSLATION
REFORM TO DECREE NUMBER 42-2010 OF THE
CONGRESS OF THE REPUBLIC, LAW THAT PROMOTES INTERNAL TOURISM
Article 1. Article 2 of Decree Number 42-2010 of the Congress of the Republic, Law Promoting Domestic Tourism, is amended, which remains as follows:
"Article 2. Day of Restitution. In order to promote national tourism, when the holiday coincides on Tuesday or Wednesday, enjoy the day immediately preceding Monday, if it occurs on Thursday, Friday, Saturday or Sunday, will enjoy the next Monday immediately.
As a consequence, the present Law will be applied for the following holidays: one of May, thirty of June, twenty of October and in any case, the rest established in other laws.
Except for the application of this Law, the days: one of January, half a day of Holy Wednesday, Thursday and Holy Friday; ten of May, fifteen of September, one of November, half a day of the twenty-fourth of December, twenty-five of December, half a day of the thirty-first of December and the day of the festivity of the town. "
Article 2. Article 2 bis is added to Decree Number 42-2010 of the Congress of the Republic, Law that Promotes Domestic Tourism, which remains as follows:
"Article 2 bis. Repeal. All provisions that contradict this Decree are repealed. "
Article 3. This Decree shall enter into force eight days after its publication in the Official Gazette.
